this is kpix 5 news. the manhunt for a fugitive ex-cop just got harder. what's changing tonight that's helping him cover his tracks. good evening. i'm elizabeth cook. >> and i'm ken bastida. the massive manhunt for christopher dorner is now centered in the mountains east

of los angeles. and anytime now, the weather could complicate an already difficult and very dangerous search. >> it's very cold. the conditions aren't very good. the snow is expected to start. >> the search is now shifting, largely to the air. through the night, law enforcement will be relying heavily on helicopters outfitted with thermal imaging equipment. cbs 5 reporter edward lawrence begins our coverage from los angeles tonight. edward? >> reporter: ken, that weather is going to cause problems. that's because at the moment, there were footprints in the snow according to the sheriff. they believe they were from the ex-lapd officer. they were following the footprints. they did not find him. however, if the snow comes in, it will cover whatever tracks he's left, if there are more out there. it also will make it more difficult for the 125 officers who are on the ground going door to door and searching the wooded areas up near big bear. police are scouring the mountains of big bear, hunting

one of their own. >> certainly he could be anywhere at this point, and that's why we're searching door to door. >> reporter: former police officer christopher dorner is wanted for a shooting rampage that left at least three people dead, including a cop. >> of course he knows what he's doing. we trained him. it is extremely worrisome and scary. >> reporter: dorner was fired from the force in 2008 for making false statements. in a document posted on his facebook page, dorner names eleven people targeted for revenge. the manifesto says the violence will be high. he says he will bring warfare to those in uniform. you will now live the life of the prey. police say dorner began his rampage on sunday. the facebook post said about quan, i never had the opportunity to have a family of my own.

i'm terminating yours. dorner's badge and id were found overnight in san diego. police say he tried to tie up an 81-year-old man and steal his boat but failed. dorner is believed to shot at least two police officers, wounding one. twenty minutes later, he shot a riverside officer to death. this afternoon, his car was found on fire in big bear. a witness said there were footprints in the snow, leading away from the car. >> i can't tell you whether he's here or not, but we're assuming that he's still in the area. >> reporter: the riverside police chief says what makes this man so dangerous is the fact that he said what he was going to do and he went out and so far he's done it. the police chief in riverside says he's targeting officers and murdering that officer was a very dangerous situation. he had no remorse and ambushed two officers in riverside. a very dangerous situation. they're going to search as long as they can tonight, but when

the weather comes in, they're going to have to stop, is what i'm told. >> we saw the pictures of officers in the area, near cabins and homes. are people in the big bear area being warned to lock doors, watch out for this guy? what are they being told? >> reporter: they're actually aren't that many people who stay up there year round. the people who live in the area are told to stay inside, don't open the door, unless you see a uniformed officer or someone you know. they say it's a very dangerous situation, is what police are telling folks who live up there. there's only about 150 houses up there, but they're very isolated in some cases, in the woods. so police are trying to check each one of them. >> all right. edward lawrence in los angeles tonight. as an ex-cop, christopher dorner knows the police playbook back to front. sharon chin tells us that makes the job of tracking and

tracking him down even tougher. >> reporter: he's believed to be well armed and wearing body armor. but his greatest weapon may be his police and military training. christopher dorner, an ex-cop, navy man, who has declared war on police, a volatile combination, according to rick smith, who now heads investigations in san francisco. >> he's already killed some people. so he's just not talking about it. he's actually taking action and he has the wherewithal, the experience and the equipment to do something about it. >> reporter: san francisco police chief put all of his officers on notice. >> he knows how we move. he knows how we train. he knows what we do. he's already said he's not afraid to die. >> reporter: dorner speaks of his advantage on his online manifesto. he tells the lapd, the violence of action will be high. whatever preplanned responses you have established for a scenario like me, shelf it! i am a walking exigent

circumstance with no off or reset button. he warns them, think before you attempt to intervene. you will not survive. >> this is pretty much a police officer's worst nightmare. >> reporter: so how do police capture someone who knows their playbook? smith says they have two advantages. their personal knowledge about dorner and sheer man power. >> to use all the resources law enforcement has. he's one person. >> reporter: smith says don't expect a peaceful ending. >> this guy is deranged and he's emotional, and he -- i don't think there's anything you can -- any argument you can make, any appeal to him, other than turn himself in, if he runs out of gas. he's going to be exhausted. >> reporter: dorner also sent a package to cnn anchor anderson cooper. in it, a dvd, a note and a bullet-riddled coin. former police chief william bratton says it's the kind of

decorative coin he would have given dorner to wish him luck in the military. in his manifesto, dorner asks that his brain be preserved to study the effects of severe depression. >> that last line almost sounds like he's getting ready to make this his last stand. >> his whole manifesto suggested that's his good-bye. we're learning more about why the lapd fired christopher dorner. this is a final appeals court rule from 2011 that upholds his removal. dorner had accused his partner of kicking a suspect several times during an arrest. his partner testified it never happened. the police review board ruled the allegations were unfounded. and what's more, dorner had received a bad performance review the day before filing his report. a little bit of rain out there tonight. this is what it looked like driving through san francisco just after 8. and our meteorologist, paul deanno, says get ready for a little bit

coast blizzard paul was talking about. so far, that's affected 29 flights in and out of san francisco. some parts of the northeast could see two feet or more of snow. san jose mayor chuck reed says the city's economy is getting better, but he still wants to raise taxes. the mayor's idea is to raise the city's sales tax. voters would have to approve it. but -- >> it now appears from our most recent survey that a majority of the voters might support another tax increase. >> in his state of the city speech tonight, reed also said san jose will be able to hire more police officers in the next years. he says money from that will come from savings on pensions. have you filled up lately? you've probably noticed that gas is getting more expensive again. but this really gave us some sticker shock. yeah, you're reading that right.

chico's gas station charging $5.03 a gallon for regular. gas prices have shot up almost 40 cents in just the past month. why? switching to the more expensive summer blend of fuel. tonight, there are new rules of the road. new rules for drivers and new rules for motorcycle riders. you've probably seen this. motorcyclists weaving in between cars. they can do that in california. but now there are written do's and don'ts for lane splitting. >> reporter: when should a motorcycle do this? >> only when it's safe. >> reporter: some think never. >> very dangerous. i see they really speed up between the cars. they hit the mirrors in some cases but just keep on going. >> reporter: it's called lane splitting. in thick traffic, motorcyclists can still move forward by riding in the narrow gap

between cars. >> you pick up five, ten minutes on the ride to work. >> reporter: california is the only state where it's perfectly legal but not everybody knows that, which may explain this youtube video. a car driver lurches in front of a motorcycle, causing a crash. >> he will start pulling over a little bit for you. but also you get the ones that do this sort of thing. they're just doing it to say they disapprove of what you're doing. >> reporter: even though it's been legal for some time, the chp has decided it's time to put out some guidelines about how you can legally lane split and be safe at the same time. the guidelines say motorcycles should only lane split going up to ten miles per hour faster than traffic. and even then, only when traffic is going less than 30 miles per hour. the guidelines also say motorcyclists should never

split between buses and rv's. >> how often am i going to go 65 on the freeway? >> what's really going to happen? >> they're going to keep splitting lanes and flying past us. realistically, that's what a bike is for, right? >> reporter: the chp also offered guidelines for people who are not on motorcycles. you are not allowed to block somebody from lane splitting. that's illegal. and liz, that could seriously hurt somebody. >> absolutely. a lot of people get motorcycles because it lets them get to and from a lot faster. but it can be really dangerous, for sure. >> reporter: we gotta all share the road. all right. coming up, got a costco card? we go undercover and find a surprising way to get through airport security without an id. the lawsuit that could be a big pay day for anyone who checks e-mail out of the office. and hello kitty in space. the class project that turned a

>> reporter: getting on an airplane can be a hassle. even grandmas and kids don't get an easy pass. >> i'm about as vanilla as can be. >> reporter: giants' pitcher sergio romo had a run-in with security after failing to show proper id, according to the tsa. and while most of us travel with a passport or driver's license, it turns out you don't need either. >> if you don't have an id, you can still fly. >> reporter: kpix 5 went undercover to each of the bay area's major airports. at sfo, a producer got through with a student id and a couple of personal credit cards. tsa agents said they'd accept a costco card. at the oakland airport, security there asked for a costco card too. in san jose, our producer skated through with a student id. >> it's about validating who you are, so if it's a library card or a school id card, they're not all government identification, but at least it's something printed with

your name on it, that we could say, yes, this is who that person is. but then there's going to be an additional screening process. >> reporter: and that was the case only when our producer showed up with no wallet or documentation at all. tsa simply took our producer aside and asked a series of secondary questions. >> do you live here in oakland? >> reporter: in less than 20 minutes, our producer was cleared to go. in all airports, our producer glided by with minimal identification. he was not subject to any secondary checks. why? because federal law doesn't require it. in fact, the tsa's website says not having an id does not necessarily mean that a passenger won't be allowed to fly. a security problem, says an aviation expert. >> every time you introduce vulnerability, our adversary is going to take advantage of that. >> reporter: he adds, don't expect to see a change in that

requirement any time soon. >> it is very difficult to get anything done absent a disaster. and that's sad. >> reporter: in san francisco, allen martin, kpix 5. how many times do you write work e- mail even when you aren't working? >> if you do, you may be able to charge your boss overtime. kiet do tells us about the new federal lawsuit. and for the record, kiet is still on the clock. kiet? >> reporter: yeah, but only for another 12 minutes or so. but if i answer an urgent phone call, text or e-mail, after that time, then california state law says that yes, i should be paid for it. pretty soon, the rest of the country could be just like us. a group of chicago police officers is doing something that worker bees across the country have only dreamed of. they're suing to get overtime pay for using their smartphones during off-hours.

>> the lawsuit is not silly. the lawsuit seeks to enforce the law. >> reporter: this man, police sergeant jeffrey allen, is at the center of the lawsuit. he claims he was pressured by his bosses to answer work e- mails on his department-issued blackberry. according to court documents, a culture has developed where police officers have felt compelled to work for free in order to maintain a coveted assignment. >> if they have an e-mail about a search warrant the next day, that is something that needs to be paid for. >> the facts as detailed by the judge show a clear violation of the fair labor standards act. >> reporter: richard is one of the country's leading experts on wage loss. he says if the cops win, then companies across the country could, like chicago, owe millions in back pay. >> looks like there is a ton of uncompensated time for these police officers. the only question is, how much and what are going to be the

damages? >> reporter: the chicago case could allow the rest of the nation to catch up to california. our state has some of the most stringent laws about working on a smartphone during off hours. still, jake mccluskey says he won't be billing his bass for ot, because they're friends. >> so you like your boss. that's why you're not billing him for it? >> if i didn't like my boss, i would be billing every minute. >> reporter: all right. all your hourly employees, go ahead and bill for those late- night e-mails, but do so at your own risk, because if it goes against your company culture, you could be labeled a nickel and dimer of the company. as always, talk to your lawyer. >> you are still on the clock, buster. >> reporter: i've got another ten minutes. >> i think i'm going to send you an e-mail, kiet. >> reporter: i'll wait till tomorrow. >> take saturday off. >> take the next day off! in your business, you
